Unlike some providers who quote base salary then add equipment fees, security surcharges, or management fees separately, our monthly fee covers everything. The only additional costs would be client-requested hardware upgrades beyond standard spec or specialised software licences specific to your business.

Generally no. The superannuation guarantee does not apply if all work is performed overseas and the worker is a non-resident of Australia. Your offshore team is employed by Staff Domain as EOR, not by your Australian entity. However, we always recommend confirming with your accountant for your specific circumstances.

Offshore staffing services are generally GST-free as services consumed outside Australia. Staff Domain invoices you in AUD and handles all local currency conversions and payments in the Philippines and South Africa.

Does the Fair Work Act apply to my offshore team?

Australian employment law generally does not apply to workers based overseas employed by a foreign entity. However, the 2024 Pascua v Doessel ruling demonstrated that the Fair Work Commission can assert jurisdiction over offshore workers if the employment relationship is structured as a direct engagement. Staff Domain’s EOR model eliminates this risk: your offshore team is employed by Staff Domain’s local entity, not by your Australian business. This creates a compliant separation protecting you from potential Fair Work Act claims.

Australian Privacy Principle 8 (APP 8) governs cross-border disclosure of personal information. Your Australian entity remains accountable for breaches by overseas recipients under section 16C. The Notifiable Data Breaches scheme requires notification within 30 days. Staff Domain’s ISO 27001 certification, zero-trust security stack, and the Philippines’ Data Privacy Act 2012 (aligned with GDPR and APPs) ensure your data meets APP 8 requirements.

PAYG withholding generally does not apply for non-residents performing work entirely outside Australia under the Australia-Philippines Double Tax Agreement (Article 15). Transfer pricing rules apply if you have a related Philippine entity β€” arm’s length pricing must be documented. Offshore workers can theoretically create permanent establishment risk if they act with authority to conclude contracts on behalf of your Australian entity. The Philippines (PHT, UTC+8) is 2 hours behind Sydney during AEST (April–October) and 3 hours behind during AEDT (October–April). Perth operates on the same time as Manila year-round. This gives 6–8 hours of direct overlap. South Africa (SAST, UTC+2) is 8 hours behind Sydney AEST and 9 behind during AEDT. SA teams are best structured for end-of day handoffs, early-morning overlap with eastern Australia, or alongside Philippines teams for extended coverage.

Your CSM coordinates this during onboarding.

What is an Employer of Record?

An EOR is a third-party organisation that becomes the legal employer of your offshore staff. Staff Domain as EOR handles employment contracts, payroll processing, tax withholding, mandatory government benefits (SSS, PhilHealth, Pag-IBIG in the Philippines; UIF, SDL, COIDA in South Africa), leave administration, and labour law compliance. You manage the day-to-day work; we manage the employment.

Without an EOR, you would need to establish a local entity, navigate foreign employment law, manage local payroll and tax, and assume all employment liability. The EOR eliminates this entirely. You get dedicated staff without foreign liability, without local entity setup costs, and without the risk of misclassifying workers (the 2024 Pascua v Doessel Fair Work ruling demonstrated the legal risk of informal offshore employment arrangements).
